Terms of Service for Bay Area Land Services

Welcome to Bay Area Land Services! We are located in Dunkirk, MD, and proudly serve Calvert County, Charles County, St. Mary's County, and Prince George's County. These Terms of Service ("Terms") govern your access to and use of our website, services, and any related communications. By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.


Please read these Terms carefully before engaging with our services.

1. Services Offered

Bay Area Land Services provides a range of excavation and land management services, including but not limited to:

Site Preparation & Grading

Foundation & Utility Trenching

Demolition & Debris Removal

Drainage Solutions

Tree Removal

Stump Grinding

Retaining Wall Construction

Irrigation Services

Land & Water Management (including erosion control)

2. Service Quotes and Estimates

All service quotes and estimates provided by Bay Area Land Services are based on the information available at the time of the quote.

Estimates: Estimates are approximations of potential costs and may be subject to change based on unforeseen conditions (e.g., hidden utilities, rock formations, unexpected soil conditions, difficult-to-access areas, or additional work requested by the client).

Quotes: For larger or more complex projects, a detailed written quote will be provided. Acceptance of this quote, often accompanied by a signed contract, will define the agreed-upon scope of work and pricing.

On-Site Assessment: For most projects, an on-site assessment is required to provide an accurate quote. We reserve the right to revise quotes after an initial assessment if site conditions differ from initial descriptions.


3. Scheduling and Project Commencement

Scheduling: Project scheduling is dependent on our current workload, weather conditions, and the timely completion of necessary preparatory steps (e.g., permits, utility marking). We will make reasonable efforts to adhere to agreed-upon timelines.

Client Responsibilities: Prior to project commencement, it is the client's responsibility to:

Ensure all necessary permits from local authorities (e.g., Calvert County, Charles County, St. Mary's County, Prince George's County) have been obtained.

Clearly mark any private underground utilities, irrigation lines, septic systems, or other buried infrastructure not typically marked by Miss Utility (Call 811). Bay Area Land Services is not responsible for damage to unmarked private utilities.

Provide clear access to the work area for our equipment and personnel.

Remove any personal items, vehicles, or obstacles from the work area.

Weather Delays: We reserve the right to delay or reschedule work due to adverse weather conditions (e.g., heavy rain, snow, high winds) that could compromise safety or work quality.


4. Payment Terms

Deposit: For larger projects, a deposit may be required before work commences. This will be clearly outlined in your project agreement or quote.

Payment Schedule: Payment schedules will be specified in the project agreement. Final payment is typically due upon satisfactory completion of the agreed-upon work.

Accepted Payment Methods: We accept [List accepted payment methods, e.g., checks, credit cards (with potential processing fee), bank transfers].

Late Payments: Invoices not paid by the due date may be subject to a late fee [Specify fee, e.g., of 1.5% per month or $XX per month] on the outstanding balance.

Collections: In the event of non-payment, Bay Area Land Services reserves the right to pursue collection efforts, including but not limited to, legal action, and the client will be responsible for all associated collection costs and legal fees.


5. Site Conditions and Unforeseen Circumstances

Hidden Conditions: Our quotes assume typical ground conditions. If unforeseen conditions are encountered during excavation (e.g., rock, buried concrete, environmental hazards, excessive water, or other unexpected subsurface obstructions), Bay Area Land Services will notify the client immediately. Additional charges for extra labor, equipment, and/or specialized disposal may apply.

Client Changes: Any changes to the scope of work requested by the client after project commencement may result in additional charges and adjustments to the timeline. These changes will be documented and approved by the client in writing.


6. Liability and Warranty

Standard of Work: Bay Area Land Services will perform all services in a professional, workmanlike manner, using reasonable care and skill, in accordance with industry standards and applicable local regulations in Calvert, Charles, St. Mary's, and Prince George's Counties.

Damage: While we take utmost care to protect your property, excavation work carries inherent risks. Bay Area Land Services will not be responsible for minor damage to lawns, driveways, or existing landscaping caused by heavy equipment operation during the course of normal, careful work. We will make reasonable efforts to minimize such impact. Significant damage caused directly by our negligence will be our responsibility to repair.

Existing Conditions: We are not responsible for damages resulting from pre-existing conditions on the property (e.g., unstable soil not identified prior to work, pre-existing structural flaws, unmarked utilities).

Warranty: We warrant our workmanship for a period of [Specify duration, e.g., 90 days, 1 year] from the completion date. This warranty covers defects in our labor, but does not cover normal wear and tear, damage caused by third parties, acts of nature, or client misuse. Materials used may carry their own manufacturer's warranties.


7. Indemnification

You agree to indemnify, defend, and hold harmless Bay Area Land Services, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of our services.

Your breach of these Terms.

Any injury, damage, or loss caused by your actions or omissions on the project site.

Any claims arising from inaccurate or incomplete information provided by you.


8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.

Any dispute or claim arising out of or relating to these Terms or your use of our services shall be resolved through good faith negotiation between the parties. If an amicable resolution cannot be reached, the parties agree to seek mediation. If mediation fails, the dispute shall be resolved through binding arbitration in Calvert County, Maryland, in accordance with the rules of the American Arbitration Association, or through the appropriate courts in Calvert County, Maryland.


9. Intellectual Property

All content on the Bay Area Land Services website, including text, graphics, logos, images, and software, is the property of Bay Area Land Services and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from our website without our express written permission.


10. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.


11. Changes to Terms

Bay Area Land Services reserves the right to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our services following the posting of any changes constitutes acceptance of those changes.
